ABS Rule Manager Internet Privacy Statement

Site Traffic Monitoring
ABS collects anonymous information about every visit to our site by tracking Internet Protocol (IP) addresses on an aggregate basis. We do not link IP addresses to any personal information associated to the individual visitor. We use this information only for statistical purposes to determine the server load that is used to optimize efficiency and performance so as to serve you better during your future visits. We also collect browser type, access time, and the URL where a user is entering or exiting the site.

Cookies
In order to provide better service and to address security hazards, ABS uses cookies. A cookie is a small piece of information that a Web site stores on your Web browser on your PC and can later retrieve. Cookies cannot be read by a Web site other than the one that set the cookie. Most cookies only last through a single session, or visit to our site. No cookie will contain information that will enable anyone to contact you via telephone, e-mail, or any other means. ABS Rule Manager Terms of Use

YOUR USE OF THIS WEB SITE CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS OF USE.

The Web site, including all of its features and content (the "Web Site") is a service made available by American Bureau of Shipping ("ABS") and all content, information, services and software ordered or provided on or through the Web Site ("Content") may be used solely under the following terms and conditions and the terms and conditions contained in the ABS Rule Manager License Agreement (together referred to herein as "Terms of Use"). ABS reserves the right to modify these Terms of Use at any time. Updated versions of the Terms of Use will appear on the Web Site and are effective immediately. You are responsible for regularly reviewing the Terms of Use.

WEB SITE LIMITED LICENSE. As a user of The Web Site you are granted a non-exclusive, nontransferable, revocable, limited license to access and use the Web Site and Content in accordance with the Terms of Use. ABS may terminate this license at any time for any reason.

INTELLECTUAL PROPERTY RIGHTS. ABS is a registered trademark of American Bureau of Shipping. The Rules are the property of ABS. IMO Codes, regulations and interpretive guidance may be the property of IMO or other third parties (collectively “Third Parties.”) Copyrights, trademarks, service marks, patents or other proprietary rights and laws protect the Web Site and its Content. All rights, title and interest (including all copyrights and other intellectual property rights) in the Web Site and its Content (in both print and machine-readable forms) belong to ABS or to Third Parties. You acquire no proprietary interest under these Terms of Use in the Web Site, its Content or copies thereof. Except as expressly provided in these Terms of Use, nothing contained herein shall be construed as conferring any license or right, by implication, estoppel or otherwise. You may not use the Web Site or its Content in any manner that infringes the copyrights or proprietary interests therein, nor may you remove or hide copyright notices contained in the Content.

REGISTRATION. ABS Rule Manager is a service intended for ABS Clients only. Users are required to provide ABS with accurate and complete registration information. It is your responsibility to inform ABS of any changes to that information. Unless your company has registered as an organization with a designated administrator, your registration is for a single individual.

AUTHORIZED USERS. ABS does not permit anyone other than you or those directly employed by your organization that you have designated and for whom you have established a password to use the application. ABS does not authorize multiple individuals to use a single name and password whether on a network or otherwise. You are responsible for preventing such unauthorized use. You may not assign your rights, disclose your password or delegate your duties as administrator without the prior written consent of ABS. If you believe there has been unauthorized use, you must notify ABS immediately by emailing ABS at: RuleManager@eagle.org. ABS may revoke your license to use the Web Site for misuse of your password.

ERRORS AND CORRECTIONS. ABS strives to maintain accurate and up-to-date information on the Web Site, but ABS makes no warranties or representations that the information will be correct, accurate, timely, or otherwise reliable. ABS does not represent or warrant that the Web Site or the Content will be error-free, free of viruses or other harmful components, or that defects will be corrected or that it will always be accessible. ABS may periodically add, change or improve any of the information products, services, programs and technology described on the Web Site without notice.

DISCLAIMER. THE WEB SITE AND THE CONTENT ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. ABS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

The information and guidance provided in the ABS Rule Manager is believed to be accurate but may not be complete. Search routines have been incorporated into the ABS Rule Manager for the convenience of the users. Various books and documents have been tagged to support the search routines but the results may not be all-inclusive even within the database nor may they reflect all applicable requirements. Classification and certification are based on demonstrated compliance with the applicable ABS Rules or statutory requirements. ABS procedures and process instructions are intended to assist in interpreting the Rules and statutory conventions but in case of conflict the Rules and statutory instruments govern. Neither individual Rules, nor statutory instruments, nor process instructions and procedures can be interpreted in isolation but must be reviewed in the context of other Rules, statutory instruments, procedures and process instructions. The "Scope and Conditions of Classification" as contained in the entirety of Part 1 of the ABS Rules for Building and Classing Steel Vessels, including the Limitation of Liability provisions, are hereby incorporated by reference.

LIMITATION OF LIABILITY. The entire risk arising out of the use of the Web Site and its Content remains with you the user. ABS, its affiliates, and its and their officers, directors, employees, subcontractors and agents shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting from, arising out of or in any way related to (a) any errors in or omissions from the Web Site and the Content, including but not limited to technical inaccuracies and typographical errors, (b) any third party web sites or content therein directly or indirectly accessed through links in the Web Site, including but not limited to any errors in or omissions therefrom, (c) the unavailability of the Web Site, the Content, or any portion thereof, (d) your use of the Web Site or the Content, or (e) your use of any equipment or software in connection with the Web Site or the Content.

In no event shall ABS, or its employees or agents be liable for any indirect, consequential, incidental, special, punitive or other damages whatsoever (including, without limitation, attorneys’ fees, damages for loss of business profits, business interruption, or loss of business information), even if ABS has been advised of the possibility of such damages.

The combined liability of ABS and Third Parties in connection with any other claim arising out of or relating to the Web Site and its Content or the use thereof shall be the amount of your actual direct damages not to exceed U.S. $500.00 (Five Hundred United States Dollars). Your right to monetary damages shall be in lieu of all other remedies which you may have against ABS or any Third Party.

INDEMNIFICATION. You agree to indemnify, defend and hold harmless ABS, its officers, directors, employees, agents, licensors, suppliers and any Third Parties information providers to the Web Site from and against all claims, losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from your use of the Web Site and its Content or any violation of these Terms of Use.

GOVERNING LAW . By accessing this Web Site and its Content you agree with ABS that any claim you may have against ABS in contract, tort or otherwise in respect of any information or advice expressly or impliedly given on this Web Site, or in respect of any inaccuracy herein or omission herefrom, shall be governed by the law of the State of New York, U.S.A., without regard to its conflicts of laws rules.
