ABS SafeNet Internet Privacy Statement

Protecting your privacy and the security of your information is important to ABS. ABS also realizes how important security is to you, so we have taken a number of steps to enhance the safety and confidentiality of private information sent to or from ABS over the Internet. Access to Survey Status information via SafeNet requires the use of an ID and password as a security measure that helps protect your confidential information. This allows ABS to verify your identity, thereby allowing you access to your fleet information, while, at the same time, assisting in the prevention of unauthorized access.

Site Traffic Monitoring
ABS collects anonymous information about every visit to our site by tracking Internet Protocol (IP) addresses on an aggregate basis. We do not link IP addresses to any personal information associated to the individual visitor. We use this information only for statistical purposes to determine the server load that is used to optimize efficiency and performance so as to serve you better during your future visits. We also collect browser type, access time, and the URL where a user is entering or exiting the site.

Data Transmission Security
Access to your fleet information in SafeNet requires that a "secure session" first be established, using Secure Socket Layer (SSL) technology. A secure session is established anytime you access SafeNet on our secure online area. This provides a "security handshake" to initiate the connection. This encrypts and decrypts the data sent. The encryption is based upon technology that uses military-grade public/private key encrypted information in the client request and server response. Simply put, SSL technology creates a private conversation that only your computer and ABS systems can understand. The SSL technology secretly encodes information as it is being sent over the Internet between your computer and ABS systems, helping to ensure that the information remains confidential. The use of SSL requires two components: an SSL-compatible browser and a Web server to perform the "key-exchange" that establishes an SSL connection to ABS Web server systems. To benefit from SSL technology, you will need a browser with SSL capabilities, such as Netscape 4.7 and Microsoft's Internet Explorer 5.5. (Note that some older versions of browsers will not support SSL sessions).

Cookies In order to provide better service and to address security hazards, ABS uses cookies. A cookie is a small piece of information that a Web site stores on your Web browser on your PC and can later retrieve. Cookies cannot be read by a Web site other than the one that set the cookie. Most cookies only last through a single session, or visit to our site. No cookie will contain information that will enable anyone to contact you via telephone, e-mail, or any other means. You can set up your Web browser to inform you when cookies are set or to prevent cookies from being set. Please note that if you have chosen to disable cookies on your browser, you will not be able to access SafeNet information.

 


ABS SafeNet Terms and Conditions of Use

YOUR USE OF THE WEB SITE CONSTITUTES YOUR AGREEMENT TO BE
BOUND BY THESE TERMS AND CONDITIONS OF USE.

The Web site, including all of its features and content (the "Web Site") is a service made available by American Bureau of Shipping ("ABS") and all content, information, services and software ordered or provided on or through the Web Site ("Content") may be used solely under the following terms and conditions and the terms and conditions contained in the ABS SafeNet License Agreement (together referred to herein as "Terms of Use"). ABS reserves the right to modify these Terms of Use at any time. Updated versions of the Terms of Use will appear on the Web Site and are effective immediately. You are responsible for regularly reviewing the Terms of Use.

WEB SITE LIMITED LICENSE. As a user of The Web Site you are granted a non-exclusive, nontransferable, revocable, limited license to access and use the Web Site and Content in accordance with the Terms of Use. ABS may terminate this license at any time for any reason.

INTELLECTUAL PROPERTY RIGHTS. ABS and SafeNet are registered trademarks of the American Bureau of Shipping. Except as expressly provided in these Terms of Use, nothing contained herein shall be construed as conferring any license or right, by implication, estoppel or otherwise, under copyright or other intellectual property rights. You hereby agree and understand that copyrights, trademarks, service marks, patents or other proprietary rights and laws protect the Web Site and its Content.

REGISTRATION. Certain sections of the Web Site require you to register or to have pre-registered. If registration is requested, you agree to provide ABS with accurate and complete registration information. It is your responsibility to inform ABS of any changes to that information. Each registration is for an individual only, unless specifically designated otherwise on the registration page or in pre-registration materials.

ABS does not permit anyone other than you or those you have designated and for whom you have established a password to use the sections requiring registration by using your name or password. ABS does not permit access through a single name and password being made available to multiple users on a network or otherwise. You are responsible for preventing such unauthorized use. If you believe there has been unauthorized use, you must notify ABS immediately by emailing ABS at:

ERRORS AND CORRECTIONS. ABS uses all reasonable efforts to include accurate and up-to-date information on the Web Site, but ABS makes no warranties or representations that the information will be correct, accurate, timely, or otherwise reliable. ABS does not represent or warrant that the Web Site or the Content will be error-free, free of viruses or other harmful components, or that defects will be corrected or that it will always be accessible. ABS may periodically add, change or improve any of the information products, services, programs and technology described on the Web Site without notice

DISCLAIMER. THE WEB SITE AND THE CONTENT ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. ABS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. ABS disclaims all responsibility for any loss, injury, claim, liability, or damage of any kind resulting from, arising out of or in any way related to (a) any errors in or omissions from the Web Site and the Content, including but not limited to technical inaccuracies and typographical errors, (b) any third party web sites or content therein directly or indirectly accessed through links in the Web Site, including but not limited to any errors in or omissions therefrom, (c) the unavailability of the Web Site, the Content, or any portion thereof, (d) your use of the Web Site or the Content, or (e) your use of any equipment or software in connection with the Web Site or the Content.

LIMITATION OF LIABILITY. The entire risk arising out of the use of the Web Site and its Content remains with the recipient. ABS shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting from your use of the Web Site or its Content. In no event shall ABS and/or its employees or agents be liable for any direct, consequential, incidental, special, punitive or other damages whatsoever (including without limitation, damages for loss of business profits, business interruption, or loss of business information), even if ABS has been advised of the possibility of such damages.

INDEMNIFICATION. You agree to indemnify, defend and hold harmless ABS, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Web Site from and against all claims, losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use.

THIRD PARTY RIGHTS. The Disclaimer, Limitation of Liability and Indemnification clauses above are for the benefit of ABS and its officers, directors, employees, agents, licensors, suppliers, and any third party information providers to the Web Site. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.
