USCG maritime security regulations finalized

The U.S. Coast Guard has issued its final regulations relating to maritime security. These regulations replace the interim rules issued on July 1, 2003. The new regulations mainly clarify previous items and few substantive changes have been made.

The submission date for security plans is now December 31, 2003, moved back from December 29. Vessel and facility security plans must be in full effect not later than July 1, 2004. Various alternative security programs submitted by specialized industry groups were approved.

Owners should be aware, however, that the new regulations do not address the continuing dispute between the US Coast Guard and the US Congress over the interpretation of the Maritime Transportation Security Act (MTSA). Congress continues to insist that owners of foreign flag vessels calling at US ports must submit security plans to the Coast Guard for approval. The Coast Guard, taking due account of the international nature of shipping, has stated that such submittals are unnecessary.
